An international green energy producer entrusted us with running the full environmental procedure for a wind farm project in Lower Silesia. The site was covered by a local zoning plan but still required complete environmental documentation, coordination of the administrative procedure led by the Regional Director for Environmental Protection (RDO\u015a) in Wroc\u0142aw, and quick action throughout. We guided the project through every stage of the administrative process \u2013 from filing the application, through the EIA report, to consultations with the authority and the preparation of responses to RDO\u015a requests. The result? An environmental decision issued without delay, despite formal and technical requests regarding the project\u2019s impact on environmental and natural elements.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Client\u2019s Challenge \u2013 What problem did the investor want Ansee to help with?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The client needed end-to-end management of the environmental procedure for a planned wind farm. A local zoning plan (MPZP) was already in place, but complete environmental documentation was still required \u2013 from pre-construction monitoring, through the Project Information Sheet (KIP), to the EIA report.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Speed and certainty in obtaining the environmental decision were critical, given the tight schedule. The investor had to stick to a strict timetable to make use of the grid connection.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The assignment covered not only preparing the documentation itself but also providing active support to address formal and environmental risks as early as the procedural stage. We also maintained an active, ongoing dialogue with the Regional Directorate for Environmental Protection (RDO\u015a). The investor needed an experienced partner \u2013 one that would prepare the required documents and also guide them through a complex, fast-moving administrative procedure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A local zoning plan (MPZP) was in force at the project site and the technical parameters Ansee adopted for the environmental documentation \u2013 which ended up in the final decision \u2013 were taken directly from that plan.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">First steps of the collaboration: formal preparation of the project to obtain an environmental decision<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The formal stage began with preparing the full environmental documentation, based on pre-construction monitoring run by Ansee. In line with current guidelines, we carried out a full year of bird and bat monitoring, alongside a nature inventory covering all phenological periods. Particular weight was put on meeting acoustic requirements, which were critical for the project\u2019s location.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because the site was covered by a local zoning plan (MPZP), the project parameters were taken straight from it. The application for the environmental decision was filed in 2023, and the whole process took around 1.5 years.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Requests from the Regional Directorate for Environmental Protection (RDO\u015a) for additional information<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">After the formal stage was complete, the next step was to wait for an information request from the Regional Directorate for Environmental Protection (RDO\u015a). In the end, three such requests were issued, covering:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An assessment of the potential threat to birds of prey in the vicinity of the white-tailed eagle protection zone.<\/li>\n\n\n\n<li>Noise.<\/li>\n\n\n\n<li>An assessment of the cumulative impact with other projects.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">The first RDO\u015a request and Ansee\u2019s response<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The first RDO\u015a request concerned the nature section of the documentation, specifically avifauna and chiropterofauna. No objections were raised regarding other animal groups.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The most significant issue turned out to be the potential threat to birds of prey \u2013 related to migration and the proximity of the white-tailed eagle protection zone. In response, the Ansee team put forward proposals for mitigation measures aligned with RDO\u015a\u2019s expectations and the investor\u2019s interests.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The solution was developed after direct consultations with RDO\u015a and was designed to clearly rule out the risk of a significant impact that could lead to the refusal of an environmental permit. This showed the Ansee team\u2019s flexibility and its readiness to deploy solutions to challenges as they emerged.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The second request from RDO\u015a concerned environmental analyses<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The second RDO\u015a request concerned environmental issues such as noise, shadow flicker, and landscape. Here, the analyses Ansee had prepared, along with our clarifications, proved fully sufficient and did not require any changes or additional explanations. This confirmed the quality and completeness of the documentation prepared at the earlier stages and the soundness of the design approach we had adopted.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Third Request from RDO\u015a: Complexity of the cumulative assessment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The third RDO\u015a request concerned formal and legal issues from an environmental perspective \u2013 specifically, the cumulative impact assessment and the inclusion of all nearby developments, primarily as regards noise.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In response, the Ansee team analyzed the issue in greater detail and prepared a response covering all relevant aspects, consulting the findings with both RDO\u015a and the investor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">We also clarified concerns regarding the project\u2019s design alternatives<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A separate issue concerning project alternatives also came up during the proceedings. RDO\u015a challenged the proposed alternative option because it differed only in higher sound power, which \u2013 in the authority\u2019s view \u2013 did not meet the statutory definition or the standards established by case law.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In RDO\u015a\u2019s view, such a difference did not allow for a meaningful distinction between options or the selection of a genuinely alternative solution. We had to provide detailed explanations highlighting the limitations resulting from the applicable local zoning plan.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After presenting these arguments, the RDO\u015a accepted our position.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The decision was obtained. However, this was not the end of our work<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Obtaining the environmental decision did not mean the end of our work with the investor. It was crucial to analyze the wording of the decision itself carefully \u2013 its provisions are binding for the later stages of the project, including construction. Authorities will sometimes include parameters in the decision that don\u2019t fully match the content of the environmental report.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Summary of the investor\u2019s collaboration with Ansee<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The heart of our role on this project was not only analytical and documentation work but also problem-solving \u2013 alongside the Regional Directorate for Environmental Protection (RDO\u015a) and the investor. We held phone calls and in-person meetings to address concerns and clarify what the documentation set out to do. This let us reach solutions that were acceptable to all parties and that safeguarded both environmental interests and the project\u2019s commercial goals.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>How did we obtain an environmental decision for a wind farm under time pressure and clear roadblocks for the project?
